What happens next for ‘freed’ Britney Spears, after DUI arrest

Britney Spears’ life is once again out of control and veering erratically between lanes — just like her car was before her arrest on Wednesday night.

The 44-year-old “Womanizer’ star was “crying and very tearful,” we’re told, while being arrested for driving under the influence in Ventura County, California, bringing months of public uncertainty over the singer’s well-being to a toxic head.

A source close to Spears told Page Six that she has, for a while now, been ignoring what friends call a dire need for help — and the arrest could land her in jail or rehab, particularly as a substance was found inside her black BMW convertible and sent out to a lab for testing, according to a source.

“The people around her are working on a plan. They would very much like to get her into a treatment center so she can have the time and space to get herself healthy and on the right track. It would be a medical detox,” the close source told Page Six.

This comes after news that police found pills — which TMZ reported were believed to be Adderall — in her car when she was pulled over.

“The last thing she wants is to go to jail,” the close source said. “She is heartbroken about the whole situation, but she has no one to blame but herself. And she is well aware of that.”

Indeed, Spears’ own manager, Cade Hudson, echoed those sentiments Thursday, telling Page Six: “Hopefully this can be the first step in long overdue change that needs to occur in Britney’s life,” suggesting it could be time for her family to intervene.

“Hopefully she can get the help and support she needs during this difficult time,” Hudson added.

However, Spears has had a rocky road when it comes to her family being involved with her affairs. She was placed in a conservatorship agreement in 2008, which left her every move controlled by her father, Jamie Spears, and a lawyer.

It was only after a huge public outcry and a whole “Free Britney” movement that it was lifted by a Los Angeles court in 2021.

The greatest fear for many is that Britney could go back under a conservatorship.

Lashawn Thomas, who previously worked on a similar conservatorship case with TV’s Wendy Williams, told Page Six that would be an extreme move.

Before her arrest, Spears posted social media video of herself in a lace body suit — and suffering a nip slip. Her Instagram was deleted after she was arrested Wednesday. Instagram/Britney Spears

She noted that the lawyer who got Spears out of the conservatorship “plays a large role in Britney’s treatment now and what’s next.

“Because of … how hard it was for her to get out of the conservatorship, [Britney] might not be amenable to any judicial oversight at all.”

In order for a court intervention to occur without Britney’s sign off, it would have to be proven that she is a danger to herself, and legal experts consulted by Page Six said the DUI alone would likely not meet that standard.

However, getting treatment could help her avoid jail.

“Realistically, [Spears] could be required to attend rehab as part of a pre-trial diversion program, or treatment could be a condition of probation if there were a conviction or plea to a DUI or reckless driving charge,” said Thomas.

She also explained that there are a myriad of alternative treatment plans aside from conservatorships, which are usually reserved for worst-case scenarios where people can’t function well on their own.

Now, legal experts say Spears could go back into some form of monitored protection. Instagram/@britneyspears

Spears has had a rocky road with many of her close family members, whom she largely blamed in her 2023 autobiography “The Woman in Me,” for allowing the conservatorship to continue for so long.

Among those who has has struck out at publicly are her father, mother Lynne Spears and younger sister, Jamie Lynn Spears.

In 2023, she divorced her third husband, Sam Asghari, after 14 months. She’s also fired some of her staff, the close source said.

In a statement in which he referenced “long overdue change that needs to occur in Britney’s life,” Hudson also said that “Her boys” — Sean Preston, 20, and Jayden James, 19, Spears’ sons with second husband Kevin Federline — “are going to be spending time with her. Her loved ones are going to come up with an overdue needed plan to set her up for success for well being.”

The close source added: “Her sons are with her right now. They love her and want to support her and just want her to feel better.

“Right now everyone is just waiting to see what the tests” on what was found in her car reveal, the close source said. “Britney knows she has to face the consequences whatever they may be. But we are just praying it is rehab and not jail.”

A source close to Spears’ ex-boyfriend Paul Soliz, who she dated after divorcing Asghari, told Page Six that the singer has been in touch.

“They are not together. But they still have phone conversations. She just needs someone to vent to,” the source says of Soliz — adding that he saw worrisome signs about the star’s mental health while they dated.

“When they were living together they would get into arguments and fights. He mentioned at one point that she [Britney] needed help. I could see it myself,” the source close to Soliz said. “Britney’s always needed help.”

This week, the California Post reported that police have been called to Spear’s Thousand Oaks mansion 14 times in the past two years, including for multiple well-being checks.

The October 2025 release of ex-husband Federline’s tell-all memoir, “You Thought You Knew” — which included allegations that Spears did cocaine while breastfeeding their sons and often displayed “erratic behavior” like standing in their sons’ doorway at night holding a knife — sent her into a “downhill” spiral that ultimately led to her DUI arrest, a Spears source told Page Six earlier this week.

“But the truth is, this has been going on for a while,” that source added. “Her behavior has become increasingly erratic in recent months. She goes from being fine to being not.”

No longer after, she was reportedly spotted driving erratically in Los Angeles.

“It’s been a very hard couple of months … ” the Spears source said. “The last thing she wants is to be judged publicly all over again.”

But the public has already had a lot to say about Spears lately, with widespread concern sparked by head-scratching social media videos of her dancing in a jerky manner.

The global superstar, who has sold more than 150 million records world wide, is worth around $150 million after selling her music catalog for a reported $200 million to the private company Primary Wave last year, according to Forbes. FilmMagic

She posted one just hours before her arrest — similar to one a week earlier that showed her suffering a nip slip in lacy lingerie.

A video from September 2025 showed the floor of her Thousand Oaks mansion covered in dog poop. In 2023, she stunned fans by dancing with what appeared to be knives, though she later insisted they were “fake.”

On her 43rd birthday in December 2024, Spears posted a bizarre clip of herself claiming that she was really “turning five-years-old” and that she has to “go to kindergarten tomorrow.”

Following her arrest, Spears or someone close to her deleted her Instagram profile.

Now, even her most loyal fans are left wringing their hands over the situation.

“It’s so sad to see how Britney wasn’t truly freed by the #FreeBritney movement,” Pilar Vigneaux, who organized the #FreeBritney movement that called for the singer to be freed from her conservatorship, told Page Six.

The source close to Spears, meanwhile, told Page Six the singer is not taking her actions lightly.

“She’s devastated. This has scared the crap out of her,” the said. “She knows what’s happened is very, very bad and has the potential to impact not just her life, but everyone around her, especially her boys. She feels a lot of regret over what has happened.

“This is not about getting her back to work, this is about Britney living a fulfilled and healthy life with her boys and her family.”
